Four Canadian laws shape what a website privacy policy, cookie banner, and email signup form need to say. Here is what each one asks of you.
PIPEDA
Canada's federal privacy law. It covers federally regulated businesses and personal information moving across provincial or national borders. It requires meaningful consent and plain information about what you collect and why.
BC PIPA
The Personal Information Protection Act covers most private businesses in British Columbia. It requires consent to collect personal information, a stated purpose, and a named person who answers privacy questions.
Quebec Law 25
Quebec's updated privacy law sets the strictest rules in Canada. If you do business with Quebec residents, cookies that identify, locate or profile visitors must stay off until the visitor opts in. Penalties reach up to $25 million or 4% of worldwide turnover, whichever is greater.
CASL
Canada's Anti-Spam Legislation applies when you email marketing messages, including to a list built from a signup form. You need consent, a clear sender identity, and a working unsubscribe link. Penalties reach up to $10 million per violation for businesses.

Do I really need these policies?
If your website collects any information from visitors, whether that's a contact form, an email signup or analytics, then a privacy policy is expected and in many places required. Terms and conditions for a website are not required by law in most cases, but they set the rules for visitors and buyers. A cookie policy and cookie consent banner matter if you use cookies, which most sites do. If you're unsure what applies to you, ask your lawyer.
Do I need a privacy policy in Canada?
If your website collects personal information, such as names and emails through a contact form, Canadian privacy law expects a privacy policy and some provincial laws require one. Quebec's Law 25 also requires plain-language wording. If you're unsure what applies to your business, ask your lawyer.
Is a cookie banner required in BC?
No BC law names cookie banners. BC's Personal Information Protection Act does require consent to collect personal information, and analytics and ad cookies often collect some. A consent banner is the standard way to ask. If your site serves Quebec visitors, Law 25 adds stricter rules for tracking cookies. If you're unsure what applies, ask your lawyer.

Your policies are updated to reflect the changes, and you're sent an email notice. You don't have to rewrite anything or watch for new rules.
How do I put the policies on my website?
Each policy is added to a page on your site by pasting in a short piece of code. If Misfit Media built or hosts your site, we'll do it for you. Otherwise we can walk you through it or do it for you.
Do I need to be a Misfit Media web design or hosting client?
No. This works as a stand-alone plan for any website, and it's also available as an add-on for our web design and hosting clients.
What does it cover if I have more than one website?
The plan covers one website. If you have more than one, get in touch and we'll sort it out.
